We advise all customers to please read our terms and conditions carefully before placing any orders, as once items have been purchased, you are agreeing to abide by these. Our terms and conditions may be modified from time to time, without notice. If changes have been made after you have placed an order it will not affect your order, unless the change made was required by law.

GENERAL CONDITIONS

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

ORDERING & PAYMENT
​
Payment is required in full prior to shipping or to place an out-of-stock item into production. Anna Willms Textiles only accepts payment via wire transfer. All payments must be in Euros. The exchange rate that will apply is determined by your card issuer. Please contact your card issuer for further information on the applicable rates of exchange. You agree that we may issue you with invoices in electronic form by email. Errors and omissions are subject to correction. Unless otherwise stated in writing, prices charged will be those prices set out in the Seller’s price list which is in force at the date of placing the order. All prices are exclusive of VAT which will be charged as applicable. Unless otherwise specified, prices include the supply and delivery only of goods but not for their off-loading.
 
MODIFICATION TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
 
PRODUCTS
​
Anna Willms Textiles products are not guaranteed against natural wear, abrasion, stretch, shrinkage, fading due to su exposure, discolouration due to washing or contact with liquids, dye-lot variations or side-matching. Slight variation is to be accepted and is an inherent and unique part of the manufacturing process.
 
USE OF PRODUCTS

The suitability for use of any Anna Willms Textiles product is entirely at the discretion of the purchaser. Anna Willms Textiles will not be held responsible for any mishandling of product and recommends consulting with a workroom to confirm handling and care. Product as shown in marketing campaigns, third party photography or in editorial coverage may not be indicative of how the product should be used. Anna Willms Textiles cannot provide estimates for upholstery or wallpaper requirements based on measurements or elevations.
 
ACCURACY OF IMAGES

We have made every effort to display as accurately as possible the colours and images of products on this site, however colour representation varies from monitor to monitor and we cannot guarantee that your computer monitor’s display of any colour will be accurate, so there may be a slight variation from what you see on screen to the actual product you receive.
 
ORDER TERMS
​
We reserve the right to cancel an order in case of pricing or other technical errors. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
 
CLAIMS
​
Anna Willms Textiles considers all sales final. All packages should be opened and inspected upon receipt. Should there be an issue with an order, the client must raise a claim within 7 days of delivery. Anna Willms Textiles’s liability does not exceed the product amount. Fabric or wallpaper that has been cut, treated in any way or damaged by the client is not considered to be in original condition and will not be accepted as a return. Anna Willms Textiles is not responsible for claims resulting from typographical errors and maintains the right to refuse a return because the client has changed their mind or the project for which it was intended has changed direction. Claims will be addressed only once the product has been returned safely to the warehouse and will not be replaced prior to re-inspection upon receipt.
 
CANCELLATIONS
​
Paid orders — including stock, custom and all orders placed into production — are considered final. Cancelations must be made within 24 hours of payment for a full refund and will only be considered if the item has not yet shipped or has not yet been placed into production. Under no circumstance can an order be changed, canceled or returned once the stock has been cut, packed or shipped. If a change has to be made and can be accommodated, a restocking fee of 30% will apply.
 
LEAD TIMES & DELIVERY
​
Lead times vary depending on the product. Stocked fabrics ship within 5 to 7 business days after receipt of payment. Rush orders for items not in stock will be accommodated when possible and may be subject to an upcharge. Delivery dates for incoming/out-of-stock products are approximate; Anna Willms Textiles shall not be held responsible for delays or failure to meet expectations for any cause beyond its control, in particular acts of God. Any time expressed for delivery shall be deemed to be an estimate only, time not being of the essence of the contract unless separately agreed to in writing by the Seller. Subject to the other provisions of these conditions the Seller shall not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits or business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the goods (even if caused by the Seller’s negligence), nor shall any delay entitle the Buyer to terminate or rescind the Contract unless such delay exceeds 60 days. Where a time for delivery has been agreed but delivery is delayed for any reason beyond the control of the Seller (for example due to the lack of availability of raw materials or late delivery by a supplier) a reasonable extension of time shall be allowed to the Seller. This sub-clause shall operate independently of clause 15 (Force Majeure). Where a time for delivery is agreed and the Buyer fails for whatever reason to accept delivery, risk in the goods shall pass to the Buyer (including for loss or damage caused by the Seller’s negligence, the goods shall be deemed to have been delivered and the Seller may store the goods until the Buyer picks up the goods, whereupon the Buyer shall be liable for all related costs and expenses (including, without limitation, storage and insurance). The Buyer shall provide adequate and appropriate equipment and manual labour for unloading the goods. In the event that such labour is not provided and the Seller’s deliveryman assists with unloading, the Seller shall not be liable for any damage caused to the goods by the deliveryman unless it is proved that such damage was directly attributable to the negligence of the deliveryman.
 
BACKORDERS
​
Payment in full is required to place a product into production if it is not in stock; this is considered to be a final sale. Anna Willms Textiles works with best efforts to ensure a quoted date of delivery. Backorder dates are always an estimate and are subject to change. The purchaser is not entitled to cancel a sale due to unexpected delays.
 
FORCE MAJEURE
​
In the event of war, invasion, act of foreign enemy, hostility (whether the war has been declared or not) civil war, rebellion, revolution, insurrection or military or usurped powers, the Seller shall be relieved of liabilities incurred under the contract wherever and to the extent to which fulfilment of such obligations is prevented, frustrated or impeded as a consequence of any such event or by orders or requisitions issued by any Government Department, council or duly constituted authority or from strikes, lock-outs, breakdown of plant or restraints or delays affecting carriers or inability or delay in obtaining supplies of materials or any other causes (whether or not of like nature) beyond the Seller’s control, provided that, if the event in question continues for a continuous period in excess of 365 days, the Buyer shall be entitled to give notice in writing to the Seller to terminate the contract.
 
COPYRIGHT & INTELLECTUAL PROPERTY

All Anna Willms Textiles designs are the exclusive property of Anna Willms Textiles and are protected under copyright protection laws. Products and content displayed on the website, in showrooms and in packaging are the property of Anna Willms Textiles. Nothing in these Terms & Conditions shall be construed as granting any license or right to use any trademark, logo, product, content or service without the express written permission of Anna Willms Textiles. All content — including, but not limited to text, design, graphics, photography, illustration and code — is protected under the copyright laws of all countries.
 
ONLINE SALES

Anna Willms Textiles prohibits clients from reselling its products online or at a price lower than its established rate. Anna Willms Textiles reserves the right to protect its property and can choose to decline a sale should it feel that the client is in violation of its terms.
 
PRIVACY CONTROLS & CHOICES

Our site visitors and users have a choice about how we use their personal data to get in touch with them. Your Rights: We provide all visitors and users of our site with the opportunity to request access, correction, restriction, deletion, data portability or oppose to any personal information that has previously been provided to us in connection with the use of our website, as required by law.
